Dismiss Employee & Legal Aspects

How To Dismiss An Employee Safely

This is what happens when you dismiss an employee … especially if you terminate her without proper training. The fired worker meets with her employment attorney and tells her story. And, because you didn’t terminate correctly, the attorney will gladly accept the worker’s case because he knows a big payday coming.

His payday and the worker’s is going to be significant. Just look at these examples:

A 63-year-old director sued for age discrimination a company in El Paso, TX. The corporation asserted they fired the director for poor results. The jurors doubted the company’s presentation and gave the former manager $10,400,000. (Per Jury Verdict Research)

A 45-year old repair man sued his managers at the hospital he used to work for. He asserted his managers fired him in retaliation for taking time off under the Federal Medical Leave Act. The hospital gave no reason for the termination at the time of the firing. He got a court award of $11,240,000. (Per Jury Verdict Research)

A waitress in a motel coffee shop filed a lawsuit for unlawful termination and sexual harassment. She got $122,563. On top of that, the jurors gave her $375,000 more to compensate her for lawyer fees. The grand total the coffee shop had to pay was $497,563! (Per Employment Termination Law by Maureen E. McClain.)

According to Jury Verdict Research, the average jury award for unlawful termination is $536,927. This is for the previous 6 years, so likely you'll have to shell out more over the coming years

Take a look again at the last unlawful termination example about the coffee shop waitress. It’s unbelievable that the lawyer on this small case made $375,000. No wonder we have so many frivolous unlawful termination cases in this country. The attorneys encourage the jilted workers to file because the attorneys are going to make so much money off the lawsuits.

Here’s the problem with employment attorneys. They have the knowledge to rob innocent business people like you and me. All we want is a productive worker and it should be our right to hire and fire who we want.

But, it doesn’t have to be this way. You can outsmart the attorneys. This best source of information on firing and layoffs is the Termination Guidebook by Dan Betts.
